The Privacy Policy regulates the procedure for ensuring the security of Personal Data during the provision of Services.
In this document, we describe how we collect, process, store, disclose and transfer Personal Data when providing the Services.
The provisions of this Privacy Policy apply only to Personal Data obtained by the Company in the ways described in its terms.
References to the words “you” or “your” (or words close in meaning) mean the Customer depending on the context of the Privacy Policy.
References to the words “we”, “our” or “us” (or similar words) mean ATLAS HAUS Company.
The words he/she and their derivatives in the text of the document can be applied to both male and female faces, depending on the context of the document.

1. DEFINITION
1.1 Customer is any natural or legal person who orders Services from the Company, by using the relevant Site and/or during the relationship with the Company, by concluding the relevant regulatory and legal document.
1.2. Customer’s consent (hereinafter “Consent”) is a voluntary, specific, informed and unambiguous expression of will in which the Customer, by means of a statement or an explicit positive action, agrees to the processing of his Personal and Statistical Data.
1.3. Personal Data is any information that is in closed access, which allows to directly or indirectly identify the Customer and/or a natural person with whom the Company cooperates. For example, first name, last name, phone number, IP address.
1.4. Statistical Data is any information that is publicly available and directly or indirectly belongs to the Customer and/or an individual with whom the Company cooperates. For example, data about the name or address of the Customer’s company.
1.5. “ATLAS HAUS” company (hereinafter “Company” or “ATLAS HAUS”) is a service created to enable the Customer to view real estate projects and choose the type of real estate he needs.
1.6. Third party means a natural or legal person, government agency, institution or body, other than the Customer or the Company, and persons authorized by the Controller or Processor under their direct supervision to process Personal and Statistical Data.
1.7. The website of the “ATLAS HAUS” Company (hereinafter the “Site”) means a web page or a group of web pages on the Internet located at the address: https://sipatlas.com.ua/, through which the Company provides Services to Customers.
1.8. Services are an algorithm of actions performed by the Company to provide the Customer with the opportunity to get acquainted with real estate construction projects and choose the one he needs and/or order the necessary Products.
1.9. Product is a material result of human activity, which is placed on the Site and can be ordered by the Customer, according to its value, indicated in the relevant section of the Site.
1.10. Order is the execution by the Customer of the necessary algorithm of actions carried out by the Customer for the purchase of Products.
1.11. Cookie is a piece of information in the form of text or binary data that is used by the Company during your use of the Site in order to obtain additional information about you.
2. GENERAL RULES
2.1. The Company acts as the Processor of the Personal and Statistical Data it receives from the Customer in the ways specified in this Privacy Policy, and the Customer acts as the Controller.
2.2. The Company is not responsible for the processing of Personal and Statistical Data by any Third parties that are not controlled or owned by ATLAS HAUS.
3. PERSONAL AND STATISTICAL DATA
3.1. The Company may receive the following Personal data about the Customer:
3.1.1. full name;
3.1.2. e-mail;
3.1.3. contact phone number;
3.1.4. registered address or location;
3.1.5. gender, if such data is necessary for the construction of the building;
3.1.6. marital status, if such data are necessary for the construction of the building;
3.1.7. IP address.
3.2. The Company can collect data about the Customer’s preferences during his stay on the Site in automatic mode.
3.3. The Company may receive the following Statistical data about the Customer:
3.3.1. data about the Customer’s company: name, legal address, form of business activity, country of registration and activity, field of activity, information about employees and management, etc.;
3.3.2. contact details of the Customer: phone number, e-mail, etc.;
3.3.3. tax data;
3.3.4. payment data necessary for mutual settlements with the Customer and receiving payments;
3.3.5. publicly available information;
3.3.6. IP address.
3.4. The Company can receive the following Personal data about the management and employees of the legal entity:
3.4.1. full name;
3.4.2. e-mail;
3.4.3. contact phone number;
3.4.4. IP address.
3.5. The Company may receive the following Personal Data about a natural person with whom the Company cooperates:
3.5.1. full name;
3.5.2. e-mail;
3.5.3. contact phone number;
3.5.4. IP address.
3.6. The Company informs that the payment data is processed exclusively by the payment service/bank that provides payment processing services. However, in order to carry out mutual settlements, the Company may request the receipt of payment details during the signing of the contract for the provision of services.
3.7. The Company may collect Personal and Statistical Data during communication with the Customer, obtained using social networks, messengers, e-mail. In such case, such data will be processed in accordance with this Privacy Policy.
3.8. The Company may use your Personal and Statistical Data for customized marketing based on the use of Personal and Statistical Data obtained during your use of the Site, browsing records and order history.
3.9. The Company may collect Personal and Statistical data of natural persons cooperating with the Company, in accordance with the conditions set forth on the Site in the “Cooperation” section.
3.10. ATLAS HAUS does not collect or process sensitive Personal Data of the Customer, such as racial or ethnic affiliation, political views, religious or philosophical beliefs, trade union membership, genetic or biometric data, information about health, sex life or sexual orientation.
3.11. When using the Site or receiving Services, the Company may automatically collect the following Personal and Statistical Data of the Customer:
3.11.1. IP address;
3.11.2. time zone and language settings;
3.11.3. operating system, type of device and screen extension;
3.11.4. the country where you are located;
3.11.5. data about your visit to the Site, including complete information about the URL, the route of transitions to the Site and when entering/exiting the Site (including date and time), page response time, data loading errors, duration of stay on certain pages, activity on the page (such information such as scrolling and mouse movements, clicks), methods used to exit the page and telephone numbers used to contact the customer service center.
3.12. The Company has the right to collect and receive Personal and Statistical Data as follows:
3.12.1. when providing Services;
3.12.2. sale of Products and processing of the Order;
3.12.3. while using the Site;
3.12.4. when interacting with the Company’s employees by exchanging e-mails/messages, communicating with the Company’s employees;
3.12.5. during monitoring and evaluation of the Customer’s actions to detect and prevent fraud;
3.12.6. during cooperation with natural persons: architects, developers, individual customers, builders;
3.12.7. use of log files, Cookies and other tracking technologies;
3.12.8. using messengers and social networks.
3.13. The Company has the right to use Personal and Statistical Data for the following purposes:
3.13.1. provision of Services;
3.13.2. registration of the Order and sale of Products;
3.13.3. for delivery of Products;
3.13.4. to ensure the security of the Site;
3.13.5. to administer the Site and conduct internal operations, including troubleshooting, data analysis, testing and survey completion;
3.13.6. to improve the navigation of the Site;
3.13.7. communication with the Customer;
3.13.8. for cooperation with natural persons: architects, developers, individual customers, builders;
3.13.9. responses to requests from law enforcement agencies;
3.13.10. to initiate responses to legal claims, investigations or resolution of disputes with you.
4. TRANSFER OF PERSONAL/STATISTICAL DATA
4.1. ATLAS HAUS may transfer Personal or Statistical Data to subjects with whom the Company cooperates in the implementation and provision of Services:
4.1.1. Payment service/bank. In order to receive payment for the Services, your Personal Data may be obtained during the signing of the contract for the provision of services with the Customer and transferred to the payment service/bank.
4.1.1. Contractors. The Company may transfer your Personal and Statistical Data to other persons with whom it initiates cooperation, including legal and tax consultants, as well as persons who provide accounting, logistics, marketing and IT services.
4.1.1. Employees. The Company may transfer Personal and Statistical Data to natural persons with whom it cooperates, including but not limited to: architects, developers, individual customers, builders, etc.;
4.1.1. Partners. The Company may transfer your Personal and Statistical Data to marketing partners and web analytics services, solely to adapt the content displayed during your visit to the Site, and your Personal and Statistical Data will be processed in accordance with the privacy policy of the service that received them.
4.1.1. Counterparts. The Company has the right to disclose or transfer Personal and Statistical Data in the following transactions: acquisition or merger, financing, corporate reorganization, joint venture, including sale of assets or bankruptcy.
4.1.1. Courts, law enforcement agencies and state bodies. The Company has the right to transfer Personal and Statistical Data in case of fulfillment of any legal obligations, including by court decision.
5. CUSTOMER CONSENT
5.1. The Customer gives his consent to the terms of this Privacy Policy by using the checkbox, by putting a marker in the corresponding field.
5.2. By agreeing to the terms of this Privacy Policy, the Customer gives his Consent to:
5.2.1. use of his Personal and Statistical Data;
5.2.1. processing of his Personal and Statistical Data by the Company in accordance with the terms of the Privacy Policy;
5.2.1. providing the Company with additional information and Personal and Statistical Data at the Company’s request;
5.2.1. processing of his payment details by the payment service/bank in accordance with the terms of this Privacy Policy;
5.2.1. transfer of his data to third-party services, in accordance with the terms of this Privacy Policy;
5.2.1. providing the Company with data about its jurisdiction and location.
6. STORAGE AND PROTECTION OF PERSONAL/STATISTICAL DATA
6.1. The Company uses all necessary security and protection measures for Personal and Statistical Data to ensure their confidentiality and prevent loss or improper disclosure.
6.2. The Company protects and stores Personal and Statistical Data from:
6.2.1. losses;
6.2.2. unlawful use, transfer, disclosure, modification, deletion and/or destruction.
6.3. ATLAS HAUS has the right to store the Customer’s Personal and Statistical Data for 3 (three) years after the termination of the relationship in the following cases:
6.3.1. for statistical accounting;
6.3.2. if current legislation requires their storage;
6.3.3. if they are necessary for conducting business;
6.3.4. for marketing analytics.
7. GROUNDS FOR PROCESSING PERSONAL/STATISTICAL DATA
7.1. The Company processes Personal and Statistical Data on the following legal grounds:
7.1.1. Customer’s Consent;
7.1.2. receiving Services from the Company.
7.2. In cases where the basis for the processing of Personal and Statistical Data is your Consent, you have the right to withdraw it at any time. To withdraw your consent, you can send an email to: in**@si******.ua. In case of withdrawal of your Consent, the Company has the right to stop providing the Services and terminate all relations with you. If Consent is withdrawn, your Personal and Statistical Data will be irrevocably deleted.
7.3. The Company undertakes to stop the processing of Personal and Statistical Data within 15 (fifteen) business days from the moment of receiving the withdrawal of the Consent.
8. RIGHTS OF THE CUSTOMER
8.1. To ensure the basic rights of the Customer, the Company is guided by the following legislative acts:
8.1.1. General Data Protection Regulation;
8.1.2. Law of Ukraine “On Protection of Personal Data”
8.2. During cooperation with EU and EEA residents, the Company grants the following rights to the Customer:
8.2.1. Right of access. The Customer may contact us directly to request access to Personal and Statistical Data stored by us, as well as to any information.
8.2.2. Right of deletion. The Customer has the right to delete Personal and Statistical Data about himself. Personal Data in this case will be deleted irrevocably.
8.2.3. Right to data portability. We may send the Customer’s Personal and Statistical Data to Third Parties at the Customer’s request.
8.2.4. Right to rectification. The Customer has access to Personal and Statistical Data, which must be updated, corrected and supplemented at any time.
8.2.5. Right to object. The Customer has the right to object to the processing of his Personal and Statistical Data at any time.
8.2.6. Automated individual decision-making, including profiling. The Customer has the right not to be subject to a decision based solely on the automated processing of his Personal and Statistical Data, including profiling, which has legal consequences for him or similarly significantly affects him.
8.3. During cooperation with residents of Ukraine, the Company grants the following rights to the Customer:
8.3.1. receive information about the conditions for providing access to Personal Data, in particular information about Third parties to whom they are transferred; 8.3.2.
8.3.2. receive information, no later than thirty calendar days from the date of receipt of the request, except in cases provided by law, an answer about whether Personal Data is being processed;
8.3.3. send a reasoned request to object to the processing of Personal Data;
8.3.4. send a reasoned request to change or delete Personal Data;
8.3.5. to protect Personal Data from illegal processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of them, as well as protection from providing information that is unreliable or disgraces the honor, dignity and business reputation of the Customer;
8.3.6. appeal to the court with complaints about the processing of Personal Data;
8.3.7. apply legal remedies in case of violation of the legislation on the protection of personal data;
8.3.8. enter reservations regarding the limitation of the right to process Personal Data when giving consent;
8.3.9. withdraw consent to the processing of Personal Data;
8.3.10. know the mechanism of automatic processing of Personal Data;
8.3.11. to protect against an automated decision that has legal consequences for him.
8.4. In case of disclosure of Personal and Statistical Data and/or threat of disclosure of Personal and Statistical Data, the Company informs the Customer about this situation as soon as possible. The Customer’s notification of such a situation describes the mechanism of actions to prevent and/or eliminate the consequences of the disclosure of Personal and Statistical Data and/or the occurrence of such a threat, using clear and simple wording, and contains information about the Company’s measures to prevent such a situation.
9. SUBMISSION OF REQUEST
9.1. The Customer has the right to submit a request to the Company if he believes that his rights have been violated by writing a request in writing to the support of the Company at the address: 17, Ivana Dziuby Str., Kyiv, Ukraine.
9.2. The Customer’s request must contain reliable information regarding the requirements to the Company and/or a description of the violation of the Customer’s rights. If the request does not specify exact requirements, the Company has the right to refuse to fulfill the request.
9.3. We will not be able to respond to your request or provide you with Personal and Statistical Data unless we can verify your identity and confirm that the Personal and Statistical Data belong to you. In the event of receiving a request with inaccurate information and/or in the event that it is impossible to confirm the Customer’s identity, the Company has the right not to process the received request and contact the Customer for clarification. In case of receiving a response to the request for clarification, the Customer must provide a corrected request or submit a new request.
9.4. The company responds to the request or fulfills the conditions set forth in the request within 15 (fifteen) business days from the moment of its receipt.
10. RESPONSIBILITY
10.1. The Company informs the Customer that Personal and Statistical Data may be used to provide Services, and in case of disagreement with this, the Customer has no right to receive Services.
10.2. The Company is not responsible in the event that the Customer provides inaccurate Personal and Statistical Data, including the impossibility of receiving the Services by the Customer.
10.3. The Company is not responsible for any damages caused to the Customer as a result of the use of his Personal and Statistical Data by a Third Party without his knowledge, including third-party services (partners, payment systems, web analytics services, etc.), since his Personal and Statistical Data are processed in accordance with the policies privacy of such services.
10.4. The Company may link to other websites or services. The Privacy Policy of these websites and services is not governed by the terms of this Privacy Policy, and the Company cannot be held responsible for the processing of the Customer’s Personal and Statistical Data by third-party websites and services.
10.5. ATLAS HAUS is not responsible for:
10.5.1. loss of Personal Data in the event of a hacker attack, hacking of the Site software, illegal actions of Third parties, as well as actions that violate the terms of the Privacy Policy;
10.5.2. impossibility of providing Services or poor-quality provision of Services in case the Customer provides inaccurate Personal and Statistical Data or any other information;
10.5.3. provision of false information by the Customer.
10.6. Unfortunately, the transmission of information over the Internet cannot be completely secure. Although we make every effort to protect Personal Data, we cannot guarantee the secure process of transferring Personal and Statistical Data to the Site. In this regard, you are solely responsible for possible failures in the transmission of your Personal Data to the Company.
11. COOKIE
11.1. Cookies do not transmit viruses and/or malware to your device, as the data in Cookies does not change during transmission and does not affect the performance of your device in any way. They are more like logs (that is, they record the actions of the Customer and remember information about the state) and are updated every time you visit the Site.
11.2. When providing the Services, we may use the following types of Cookies:
11.2.1. Session Cookies, also known as temporary Cookies, exist only in temporary memory while the Customer is on the Site page. Browsers usually delete session Cookies after the Customer has closed the browser window.
11.2.2. Permanent Cookies are deleted on a certain day or after a certain period of time. This means that information about Cookies files will be transmitted to the server every time the Customer visits the website to which these Cookies files belong.
11.2.3. Third-party Cookies are a type of file that appear when a web page contains compressed content from external websites, such as links to other websites. For example, they can be used to track the history of the Customer’s visits to other websites.
11.2.4. Cookies of web analytics are used to analyze the behavior of Customers when viewing various pages of the Site.
11.3. The Company uses Cookies for the following purposes:
11.3.1. authentication and identification;
11.3.2. conducting web analytics;
11.3.3. marketing analytics research;
11.3.4. research of Customer preferences;
11.3.5. storage of personal preferences and settings;
11.3.6. tracking of access sessions;
11.3.7. storage of statistical data;
11.3.8. analysis of the Site.
11.4. The Company can use the following web analytics services:
11.4.1. Google Analytics;
11.4.2. Facebook Pixel;
11.4.3. own analytics system.
11.5. In many cases, web browsers by default allow Cookies to be stored on the Customer’s end device. The Customer of the website can change the Cookie settings at any time, in such a way as to block the automatic processing of Cookies or to be notified of each placement of Cookies on the Customer’s device. Detailed information on the possibilities and methods of processing Cookies is available in the settings of your browser.
12. ADULT POLICY
12.1. The Company’s services are intended for persons who have reached the age of majority. The Company does not process Personal and/or Statistical Data of minors.
12.2. The Company has the right to delete the Personal and Statistical Data of a person who has not reached the age of majority, without warning and without any consequences for the Company, as well as to stop providing the Services to such a person.
12.3. If you have information about the receipt of the Services by a person who has not reached the age of majority, please contact the Company’s support service by sending an email to: in**@si******.ua.
13. PRIVACY POLICY CHANGE
13.1. We have the right to periodically make changes to the Privacy Policy for the security of Personal and Statistical Data, and to comply with the requirements of the legislation of the jurisdiction in which we operate.
13.2. The Customer must read the new terms of the Privacy Policy and ATLAS HAUS is not responsible if the Customer has not read the new terms of the Privacy Policy.
13.3. ATLAS HAUS updates the change date of the current version of the Privacy Policy in the “Updated” line at the top of the document.
13.4. Our electronic copies of the Privacy Policy are considered true, complete, valid, legally binding and in effect at the time you visit the Site.

14.1. The Customer has the right to contact the Company’s support service at the address: 17, Ivana Dziuby Str., Kyiv, Ukraine to ensure his rights, in accordance with the terms of this Privacy Policy, or in case of violation of his rights, or to leave feedback or ask questions.
